Welcome to RK1s.co.uk terms and conditions

RK1’s and RK1Goalkeeping Products are all trading names and registered trademarks of Reece Kirk.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. This website is operated by RK1 Goalkeeping Products (collectively, "us", "we" or " RK1’s").

By accessing or using the rk1s.co.uk website or services, or the mobile versions of either, (collectively the "Website") you signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement") and any other applicable law, whether or not you are a registered member of RK1 Goalkeeping Products. RK1’s may change these Terms of Use at any time without notice, effective upon its posting to the Website. You agree to review these Terms of Use regularly to make yourself aware of any changes. Your continued use of the Website shall be considered your acceptance to the revised Terms of Use. If you do not agree to these Terms of Use, please do not use this Website.

 

 

1.            Ownership and Operation

rk1s.co.uk is owned and operated by Reece Kirk. Our registered office is at 141 Johnson Drive, Leighton Buzzard, Bedfordshire, LU7 4QR.

 

2.            Registration

You will need to register with rk1s.co.uk to place an order for products through this website.

In return for permitting you to use the rk1s.co.uk website and benefiting from our services, you agree that any information you provide to us about yourself at any time will be true, accurate, current and complete and that you will ensure that this information is kept accurate and up to date. If incorrect information is supplied, any contractual obligation rk1s.co.uk has is immediately null and void.

 

3.         Your Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

 

Conditions of Registration

The Website only sells products to individuals who can purchase with a credit card/debit card. If you are under sixteen (16), you may use the Website only with the express permission and supervision of a parent or guardian.

RK1’s reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at its discretion. If we cancel an order, it will be without charge to you.

By continuing to use this website and any of the services offered, you are confirming that you have received the consent of your parents or legal guardian. PLEASE NOTE that all minors are recommended to discuss these terms and conditions with their parents before they complete the registration process.

  

4.         How the contract for the goods is formed between you and us

When you place an order to purchase a product from the Website, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product, which is accepted by us when we send an email to you confirming that we have accepted the order. Such acceptance will be complete at the time we send the Order Confirmation Email to you.

This contract is legally binding when you have placed an order, your order has been accepted by us and we have sent you the Confirmation Email.

RK1’s will retain the title in the products until full payment has been made by you and has been received by RK1’s.

 

5.         Orders

 All orders placed through the Website are subject to RK1’sacceptance. This means that RK1’smay refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else. If your credit card has already been charged for an order that is later cancelled, RK1’s will issue you a refund.

 

International Orders

Once the package reaches its destination country any customs or import duties levied by the government of the destination country must be borne by the recipient. 

Fraud Prevention

To help us prevent fraud, orders of £150 GB pounds or more may require a landline telephone number. Card fraud is illegal and perpetrators will be prosecuted.

 

6.         Our Goods

A description of the main characteristics of goods can be found on the product pages of the Website.

Prices for goods on the Website appear on the product pages and include all UK taxes.

Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at our discretion. The prices on the Website may differ to prices in other stores, catalogues or elsewhere.

The Website contains a number of goods and it is possible that, despite our best efforts, some of the goods listed on the Website may be incorrectly priced. If we discover an error in the price of the goods you have ordered we will inform you as soon as possible. We will give you the option of reconfirming your order at the correct price or cancelling it.

We are under no obligation to sell incorrectly priced goods to you at the incorrect price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.

Some offers carry a maximum quantity per customer, if applicable, this is detailed on the individual offer.

  

7.            Delivery

Delivery costs are additional to the displayed price and vary depending on the delivery service you select, the country of delivery and the quantity/weight of goods ordered.

Please note we are currently unable to deliver to PO Boxes.

 

8.            Returns & Exchanges

 

If an exchange or refund is required then the items should be returned to us in their original condition and packaging within 28 days of your purchase.

In all cases, the items returned must be in their original condition, which includes any packaging. All goods will be inspected on return. The goods are your responsibility until they reach our Warehouse. Please ensure you package your return to prevent any damage to the items or boxes.

If you return goods claiming they are defective, we will examine the returned goods and will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible and, in any case within thirty (30) days of the day we confirm via e-mail that you are entitled to a refund for defective goods.

You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This applies to all goods that are returned.

Any orders for personalised goods are non-returnable. Some goods are non-returnable for hygiene reasons. Please note that this does not affect your statutory rights.

We will refund the monetary value of the goods returned to us, at the price you purchased them. All refunds will be for merchandise only, we cannot refund shipping costs unless the item was sent in error. We do not offer a free returns service, however if you return items for replacement, we despatch the replacement goods to you free of charge.

We reserve the right to refuse a refund or exchange if the goods returned are deemed to be damaged or tampered with. This does not affect your statutory rights.

9.         Data protection and privacy

RK1’s treat customer privacy extremely seriously. Our Privacy Policy provides details about the type of information we may collect from you and details of how we may use this information. You are asked to read our Privacy Policy, which forms a part of these Terms and Conditions and sets out the way in which your personal data is handled by rk1s.co.uk.

  

10.            Availability

RK1’s will endeavour to ensure that this website is fully operational at all times. However we cannot guarantee that the website will be fault free. In particular, access to this website may be interrupted or restricted to allow for emergency or routine repairs or maintenance to be carried out or the introduction of new facilities or services.

Further, by using this website and any sub-site, you acknowledge and agree that the Internet uses elements and relies upon services, input and facilities which are not within the control of RK1’s and if RK1’s is totally or partially prevented or delayed in the performance of any of its obligations in providing a particular service, such a situation will constitute a 'force majeure' and RK1’s shall be excused the performance for so long as such a situation endures.

For the purposes of these Terms and Conditions, the term 'force majeure' shall be deemed to include any cause affecting the performance by RK1’s of its obligations arising from or attributable to acts, events, omissions or accidents beyond the reasonable control of RK1’sand in particular, but not by way of limitation, shall include strikes, lock-outs, other industrial action, actual or threatened terrorist action, civil commotion, riot, crowd disorder, invasion, war, threat or preparation for war, fire, technical or power failure, software, hardware or telecommunication or other network failures, interruptions, disruptions or malfunctions, explosions, storm, flood, earthquake, subsidence, structural damage, epidemic or other natural or physical disaster, any legislation, regulation, rule or ruling of government, court or any competent authority.

RK1’s reserves its right to restrict, suspend or terminate your use of this website or any of our services at any time if we believe, in our absolute discretion, that you have breached these Terms and Conditions.

You agree to indemnify, defend and hold RK1’s, all of their associate companies, their directors, employees, information providers, licensors and licensees, officers and partners, (collectively, the "Indemnified Parties") harmless from and against any and all liability and costs (including, without limitation, legal fees and costs), incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms and Conditions. You will co-operate as fully as reasonably required by RK1’s as the case may be, in defence of any claim. RK1’s reserves the right, at their own expense, to assume the exclusive defence and control of any matter and you shall not in any event settle any matter without the written consent of RK1’s.

 

11.             Alterations

We may amend this website and our services in any way and at any time with or without notice to you.

 

12.            Complaints and Comments

13.            Website Use Restrictions

You may use the Content only for your own non-commercial use to participate in the Website or to place an order or purchase products from RK1’s. Any other use is prohibited unless agreed to by RK1’s in writing. You agree not to change or delete any ownership notices from materials downloaded or printed from the Website. You agree not to modify, copy, translate, broadcast, perform, display, distribute, frame, reproduce, republish, download, display, post, transmit or sell any Intellectual Property or Content appearing on the Website, including User Generated Content, without the prior written consent of RK1’s, unless it is your own User Generated Content that you legally post on the Website. Nothing in these Terms of Use shall be interpreted as granting any license of intellectual property rights to you.

 

14.            Limitation of Liability

To the fullest extent permitted by applicable laws, none of RK1’s nor any of their respective directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through this website, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if RK1’s have been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable. If this clause is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall RK1’s total liability to you for all damages, losses, and claims (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this website.

RK1’s is not responsible or liable for any User Generated Content or other Content posted on the Website or for any offensive, unlawful or objectionable content you may encounter on or through the Website. The Website, User Generated Content, Content, and the materials and products on this Website are provided “AS IS” and without warranties of any kind. To the fullest extent permitted by law, RK1’s disclaims all warranties, express or implied, including, but not limited to, implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. RK1’s reserves the right in its sole discretion to terminate your account, delete your profile and any of your User Generated Content, and restrict your use of all or any part of the Website for any or no reason, without notice, and without liability to you or anyone else. RK1’s also reserves the right to block users from certain IP addresses and prevent access to the Website. You understand and agree that some of your User Generated Content, such as that which is displayed outside your profile, in activity feeds, in other parts of the Website, or on other social platforms (e.g., Facebook and Twitter), may continue to appear on the Website or on other social platforms even after your User Generated Content is removed or terminated. These Terms of Use remain in effect even after your account is terminated. 17.       Force Majeure

RK1’s shall not be liable for any failure to perform its obligations where such failure is a result of acts of Nature (including fire, flood, earthquake).
